    Frequently Asked Bail Bond Questions

    10 Simple Facts You Should Know When You Obtain a Bail Bond


    FACT #1

    Most People Who Have a Friend or Family Memeber In Jail Need The Assistance of a Bail Agent!
    Why? It's the easiest and most expedient way to get your friend or family member released from jail. The following facts will illustrate why you need bail bond services to bail out of jail. CAUTION: Always obtain a bail bond from an ethical and experienced bail bond company!

    FACT #2

    You Have The Choice of NOT Using a Bail Bondsman!
    Here's what's you can do. You can put up cash bail to the Clerk of the Courts to bail out a person in jail. Depending on the court's particulars, you will need to ask what type of currency is acceptable: credit card, money orders, and may include all cash to the Court of the Clerk. Cash may trigger a 1275 Hearing to disclose the legality of the cash being deposited, termed "felonious obtained" funds (1275.1 (c). This occurs regularly when the bail is high and the charge is a white color crime, such as real estate fraud, medical fraud, and of course, any charge related to drugs; trafficking, sales, etc. where money laundering usually occurs.

    Please note, you will have to place the entire amount of the bail with the courts. This money is subject to forfeiture. If the person fails to attend his/her court appearance on the required date, the court will PROMPLY take the pledged money.

    People having considerable funds who post cash or comparable assets believe this results in a more affordable bail bonds, because it circumvents the 10% fee charged by the bondsman

    FACT #3

    A Certificate of Deposit is acceptable to the courts (Penal Code Section 1295 (a). Under Penal Code Section 1297 this money is subject to repayment of fines, Restitution Funds, additional fines and costs. The surplus will then be refunded the depositor within 15 days after exoneration.

    FACT #4

    Real Estate is acceptable to the courts, but must be appraised and valued at 2 X the amount of the bail bond (see section 1279 of the Penal Code). A legal description that matches the assessor's parcel number must be included In the appraisal (see Section 1280 (a) of the Penal Code).

    You can pledge other assets; such as United States Bonds or California Bonds, (Section 1298 of the California Penal Code). A hearing may be required by the courts to determine the actual value of the bonds.

    The trade-off by going direct is saving the 10% paid to the bondsman for the bail bond versus your time spent in the courts arranging for an alternative to posting bail.

    FACT #5

    Your Friend, Family Member or Family Attorney Can Request Your Bail Lowered. (Section 1269 (c) Penal Code.
    The judge will review your request and take into consideration the type of charges, past criminal history, etc.

    "If, after the application is made, no order changing the amount of bail is issued within eight hours after booking, the defendant shall be entitled to be released on posting the amount of bail set forth in the applicable bail schedule."
    FACT #6

    Penal Code Section 1302 states the defendant may surrender himself/ herself before forfeiture and monies deposited in lieu of bail will be returned to the person or persons who originally deposited the funds with the Clerk of the Court.

    FACT #7

    The Bail Bond Schedule in California Is High; therefore, using a bail bondsman is effective and timely. An average bail in California can range from $2500.00 to $250,000.00 and higher. Most bail bonds can be negotiated quickly and that includes the larger bonds. Expediency depends on the credibility of the indemnitor ( s ), their credit rating, or the collateral of those wanting to indebt themselves for the defendant. Using an experienced bail bond company can accelerate the underwriting of a bond.

    FACT #8

    A knowledgeable bondsman understands the probabilities of most cases presented to him/her, and has a good working knowledge of human behavior! The undertaking of writing a bond always involves risk, no matter what collateral Is taken to support the value of the bond.

    FACT #9

    What You'll Experience When Working With a Bail Bondman
    The information you'll need to provide a bondsman is very basic, such as;

    • "How long have you known the defendant?"
    • "Do you understand your financial commitment when signing for the defendant?"
    • "How long have been on your job?"
    • "How long have you lived in the current community?"
    • "Do you understand the 10% fee is the bail bondsman's fee for posting a bail bond?"
    • "Do you understand the terms of the bail bond agreement?"
