Jury Rejects Banana Schnapps Defense

The Banana Schnapps defense didn't work. A Denver jury found a 41 year-old Colorado woman, guilty of drunk driving and two counts of vehicular homicide in the 2009 crash that killed two Connecticut librarians who were riding in a taxi on their way to Denver International Airport.

The woman’s defense said the accident was the taxi drivers fault and that the woman drank after the crash but was sober when it happened. Prosecutors say was severely intoxicated when she lost control of her vehicle and hit a taxi van causing it to roll over killing both passengers when they were ejected.

Prosecutors say the woman fled the scene and was later arrested. Tests determined she had twice the legal limit of alcohol in her system at that time.

Initially, she said she had consumed a full bottle of Nyquil as prescribed by her doctor. But defense attorneys then said she was scared and made that up accusing the taxi driver of hitting her car her and she didn't realize it. The defense says she accidentally drank a water bottle filled with Banana Schnapps just before police contacted her, after the crash.

The court revoked her $250,000 bond and set new bail at $1 million after the verdict.

The defense attorney says she will appeal her conviction.
Sentencing is scheduled June 4.
